Star Broadcasting Ltd (t/a Sunshine 106.8)’s Promotion 'Win a luxury holiday for two to Barbados, staying at a Hilton Resort!' (‘Promotion’) is organised by Star Broadcasting Ltd in association with Adventures in Radio Ltd. The Promotion will run from Monday 15th April 2024 from 6am until Friday 26th April 2024 at 15:59 on Sunshine 106.8

The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the Sunshine 106.8 ‘Competition Terms’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.

The promotion is also subject to specific ‘partner’ (The Hilton Group) terms and conditions detailed below:

The Hilton Group Specific Terms and Conditions

The Prize: One seven-night (7), king or double-bedded accommodation-only holiday for two (2) adults at the Hilton Barbados Resort in Bridgetown, Barbados (subject to availability and selected blackout dates). Flights for the redemption of the Prize Holiday Package are provided by the Barbados Tourism & Marketing Inc. and must be booked once the accommodations have been confirmed. Adventures in Radio Ltd will oversee these bookings.

Accommodation for the redemption of the Prize Holiday Package will be provided by the Hilton Barbados.  Prize is inclusive of breakfast, Wi-Fi in all guest rooms and public areas, service charge and VAT only.

The Prize excludes: Spending money, telephone calls, tours & excursions, inter-island transportation  All expenses and incidental travel costs not expressly stated in the Prize package description, including but not limited to, all ground transportation (outside of local airport transfers in Barbados), travel insurance, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees and taxes. Holiday insurance, COVID-19 tests, visas and ESTA’s are not included and must be purchased before travel, if required.

There will only be one (1) winner. Prize winner must be over eighteen (18) years of age and their travel companion must travel on the same itinerary.

Passports are required for international travel and must have at least six (6) months validity from completion of the prize trip (i.e., the date you travel home).

The Holiday prize cannot be taken during peak seasons namely or i.e. Easter, Crop Over, Festive Season and or the New Year; blackout dates and restrictions will apply.  The Prize must be taken in full entirety – seven (7) nights – at one time and cannot be split into select dates.

The Prize must be redeemed before June 30th 2025. The prize is strictly non-transferable, no cash alternative is available, and he prize cannot be redeemed for cash. If the winner is unable to redeem the Prize within the specified time the Prize will be forfeited. 

The Prize is subject to the Hilton Barbados Resort’s terms and conditions as outlined below:

• Valid from July 1st, 2024 to June 30th, 2025. Blackout travel and stay dates include but are not limited to:
  • June 1st – 30th 2024
  • July 26th – August 9th 2024
  • December 1st 2024 – April 15th 2025.
     
• Prize is for room accommodation for two (2) persons for seven (7) nights and buffet breakfast at the Lighthouse Terrace Restaurant ONLY with no other inclusions.
   
• Original prize certificate must be presented on arrival.
   
• Prize winner to contact our Reservations Team at Reservations.Barbados@Hilton.com to book reservation.
   
• Prize certificate is not valid without authorised signature, is non-transferable and resale is prohibited.
   
• If the prize certificate is lost, stolen, destroyed, or used without permission, a replacement will not be provided in these circumstances.
   
• The prize certificate should not combined with other certificates or vouchers, and is not valid with other promos or offers.

Winner will stay at the Hilton Barbados Resort subject to availability.

The Hilton Barbados Resort shall not be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

Prize value is an approximate value only based on select travel dates.

PRIVACY POLICY/USE OF DATA:   ONLY THE NAME AND THE CONTACT EMAIL ADDRESS OF THE PRIZE WINNER WILL BE PROVIDED TO THE PRIZE PROVIDER. The General Data Protection Regulation (EU) 2016/679 provides a number of protections for use of your personal data.  Any personal data collected from the Prize Winner and provided to the BTMI as the Prize Provider and Administrator of the Prize for redemption purposes shall be subject to the Star Broadcasting Ltd privacy policy. The Prize Provider will only use the personal data of the prize winner and travel companion for the purposes of administrating the Prize redemption, unless the Prize winner and travel companion provide express consent signifying their agreement to any other processing or use of their personal data.  For Prize redemption purposes the personal data collected from the Prize winner and travel companion will be shared with the Prize Provider’s reservations affiliate and the resort which are both located outside of the United Kingdom.

Employees and their immediate families of the Barbados Tourism & Marketing Inc. and the Hilton Barbados Resort and their associated agencies or affiliated companies are not eligible to enter to win.

The Competition is open only to legal residents of the Republic of Ireland who are at least eighteen (18) years of age at the time of entry (the “Entrants”). One entry per household.

Each Entrant agrees and as a condition of possibly being awarded the Prize to release and hold harmless the Prize Provider and its affiliated companies and each of their respective officers, directors, employees, agents and insurers from and against any and all claims, causes of action and/or liability for any injuries, illness, death, loss or damage of any kind arising from or in connection with participation in and/or entry into the competition or receipt or possession, use or misuse of the Prize or any element thereof.

8.         HOLIDAY PRIZES 

8.1        Due to their complexity, these additional terms apply to holiday prize winners and (if the holiday is for the prize winner ‘plus guest(s)’) any travelling companion that accompanies the prize winner on the holiday as their “Guest”. 

8.2          Unless otherwise expressly stated in the Specific Terms, holiday prizes: 

(a) and any elements comprising a holiday prize including travel and/or accommodation must be taken up during one period, and not on non-consecutive dates; 

(b)   do not include insurance. It will be the responsibility of each prize winner (and, if applicable, each Guest that accompanies them) to take out at their own cost, all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property) which may be required or prudent to obtain; 

(c)    consist of economy class flights (if the holiday is overseas) and accommodation only (on a room only basis) and do not include airport departure or government taxes (where applicable), spending money, airport transfers, speedy boarding, any additional luggage allowance or any other expenses in relation to recreational activities, food and drink consumption, activities, other travel expenses or otherwise. These must be paid by the prize winner (and their Guests); 

(d)    must be taken within six (6) months of the closing date of the relevant Competition or the prize will lapse with the winner being entitled to no further prize or reward in its absence; and 

(e)    are subject to any prize provider terms and conditions in place from time to time, which will apply to the prize winner (and their Guests) as well. 

8.3      It is the responsibility of the prize winner (and, if applicable, each Guest that accompanies them) to ensure their ability to travel to their holiday destination and return home, and, in particular, to: 

(a)     ensure that they have a valid passport endorsed with all relevant visas and with expiry date no less than six (6) months following the proposed dates of travel or such other duration as may be required by any relevant regulation. These passports, and their holders, must not be subject to any restrictions on their rights to travel to and from the applicable country or countries.  Passport control and in-country authorities may reserve the right to refuse entry to prize winners and/or their travelling companions;  

(b)      check any travel advisories issued by the Government and determine whether they wish to accept the risk of travelling to the holiday destination;  

(c)        obtain any inoculation and comply with any health regulations required by any holiday prize destination country; 

(d)      comply with the terms and limitations of airlines, other transport providers, and the venues involved in the provision of any holiday prize, including any insurance policy relating to the holiday. In particular, entrants must comply with all health and safety guidelines and instructions and all applicable legal and regulatory requirements; and 

(e)      where the United States of America is a holiday prize destination, to apply for an Electronic System for Travel Authorisation (ESTA) for each person that is travelling. Applications must be submitted no later than three (3) days prior to the departure date. Should this form not be lodged by both the winner and their Guest(s) within this time, they will be ineligible to enter the United States of America and will therefore forfeit their holiday prize. 

8.4       We will not be responsible for any loss or damage suffered by any prize winner (and/or any Guest that accompanies them) that arises out of their failure to arrive at any holiday destination or return home from any holiday destination, nor will we have any obligation to substitute an alternative prize, cash equivalent or other compensation where a prize winner (and/or their travelling companion) is unable to travel to any holiday destination or fails to redeem a holiday prize for any reason

CLASS ACTION WAIVER 

THIS SECTION PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER AS A RESULT OF ANY AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST ANY ENTITY UNDER THIS PROMOTION WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE ACCOMMODATIONS, AMENITIES, TRANSPORATION AND OTHER PRODUCTS OR SERVICES TERMS AND CONDITIONS. THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE TERMS AND CONDITIONS. Guest agrees that the parties referenced in FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE TERMS AND CONDITIONS that may be the subject of any claim by Guest can receive immediate judicial assistance to enforce this class action waiver.
